Member States have adopted national rules transposing the provisions of Directive 90/428/EEC(1) into their national laws. A list of the transposition measures is available in the Eurlex database(2).

In accordance with Commission Decision 92/216/EEC(3), Member States have established the criteria for the distribution of funds for the safeguard, development and improvement of national breeding, and the list of the equine competitions falling under the derogation from the principle of non-discrimination. In accordance with Commission Decision 2009/712/EC(4), this information is made available on dedicated websites to which a link is provided on the website(5) of the Directorate-General for Health and Food Safety.

In the particular case of France, the information is available on the website of the ‘Institut français du cheval et de l’équitation’(6).

At the moment, there are no open infringement proceedings against France for possible non-compliance with the rules on distribution of prize money in equine competitions. However, the services of the Commission will examine the issues raised by the Honourable Member of Parliament.

In all cases where the Commission is of the opinion that European Union rules may not be complied with by the Member States, it will take appropriate actions in line with its policy on the handling of infringements. This may include a dialogue with the Member State concerned or the starting of a formal infringement procedure or both.
